Terms and Conditions

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Entrant”, “Customer”, “You” and “Your” refers to you, the person accessing this website and accepting Utopia Wins terms and conditions. “Promoter”, “Ourselves”, “Our”, “We” and “Us”, refers to Utopia Wins. “Party”, “Parties”, or “Us”, refers to both the Entrant and Promoter. “Website” refers to www.utopiawins.co.uk.

1. QUALIFYING PERSONS

1.1 The promoter is: Utopia Wins Ltd (company no. 12832248) whose registered office is 41 Worsley Rd. Bolton, BL4 9LR.

1.2 Utopia Wins operates various competitions culminating in the allocation of prizes in accordance with the terms and conditions on this website. (Each and all such competitions being referred to herein as the “Competition”.

1.3 In using this website and/or placing an order/entering the Competition with Utopia Wins, you are deemed to have read and agree to be bound by these terms and conditions.

1.4 The Competition is open to residents of the United Kingdom aged 18 years or over except employees of Utopia Wins Ltd and their immediate family and anyone otherwise connected with the creation or administration of our Competitions.

2. LEGAL UNDERTAKING

2.1 Competitions are open for entry to anyone aged 18 (eighteen) or over in the UK, and by entering a Competition the entrant will be deemed to have legal capacity to do so, you will have read and understood these Terms and Conditions and you will be bound by them and by any other requirements set out in any related promotional material.

2.2 Utopia Wins reserves the right to close a Customer’s account at any time, if they feel the Customer is abusing the services, being abusive to other Customers or staff or they have the belief that it is not genuinely the Customer that is entering.

2.3 Utopia Wins reserves the right to refuse a Customer’s Entry at the Promoter’s own discretion and all Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.

2.4 Utopia Wins reserves the right to extend the closing date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of Utopia Wins which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition.

2.5 Utopia Wins shall use its best efforts to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, Utopia Wins reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability.

2.6 Utopia Wins shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. The Promoter shall use its best efforts to ensure that the software and website used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers.

3. COMPETITION ENTRY

3.1 Route to entry for the competition and details of how to enter are via the website www.utopiawins.co.uk

3.2 Availability and pricing of Competitions is at the discretion of the Promoter and will be specified at the point of sale on the website. Each competition has a free entry route available – see below for details. The availability of a free entry route ensures that the Competition does not fall within the definition of a lottery under the Gambling Act 2005 and can be operated legally in Great Britain without any need for a licence.

3.3 In order to be eligible to enter a Competition, each Entrant (including those entering for free) must register an account with us where you will be asked to provide your email address.

3.4 To enter a Competition you must answer a testing question of reasonable skill. Failure to answer the question correctly will result in the Entrant being denied entry into the competition.

3.5 Once ready to purchase your tickets provide your contact and payment details, check all your details carefully and endorse the declaration at checkout, confirming you have read and understood the Competition Terms and Conditions.

3.6 Once you have purchased your tickets and your payment has cleared we will contact you via email to confirm your entry into the Competition. NB when entering online and/or by post you will not be deemed entered into the Competition until you have received our email confirmation of tickets.

3.7 The Entrant can enter each Competition up to a maximum of twenty five (25) times.

4. PROMOTION PERIOD

4.1 Each Competition will run for a specified period, see each Competition for details of start and end times. If any Competition is sold out prior to the stated specified period, Utopia Wins can commence that specific Competition judgement process earlier.

4.2 If after the specified end time of the specific competition is not sold out Utopia Wins will extend the specific competition for another fixed period equal to the original promotion period. This roll over can only be performed a maximum of four (4) times.

4.3 If after the maximum roll over period has expired and ticket sales are insufficient to cover all incurred costs to the promoter then the Competition will be deemed complete and the judgement process will continue with all entries received and a cash alternative will be awarded to the winner (This will amount to 70% of ticket sales).

5 COMPETITION JUDGEMENT

5.1 There will only be one (1) winner for each Competition unless the Promoter states otherwise.

5.2 The winner will be drawn using a legitimate random number generator and the results will be live streamed on Facebook (or such other live streamed internet platform as the promoter chooses. The results video will then be posted across all of our social media platforms).

5.3 The winner will be contacted via the email addressed provided at the time of registration. It is the Entrants responsibility to ensure that these details are accurate and up to date. The promoter will not be held responsible for incorrectly submitted details by the Entrant.

5.4 If for any reason Utopia Wins is unable to contact a Winner within 14 days of the end of a Competition or the Winner fails to confirm acceptance of the prize or the Winner is disqualified as a result of contravening any of these Terms and Conditions, the Winner will forfeit the prize. A new Winner will be drawn from remaining qualifying entrants. For the avoidance of doubt once the prize has been forfeited, the original Winner will have no further claims against Utopia Wins Ltd.

5.5 In the event of the Promoter closing a Competition early, the winner will be selected from all eligible entries received up to the point of closure. The Promoter reserves the right, at its sole discretion, to close a competition early without selecting a winner. In this event the Promoter will give all Entrants a refund.

6. WINNERS

6.1 It is an essential requirement that the Winner provides proof of identification in order to facilitate the arrangement of the prize handover. Any failure to fulfil this requirement may result in the Winner being disqualified and the Promoter retaining the prize.

6.2 All Winners will be requested to consent to provide photographs and/or videos and personal details for use in our marketing/promotional material.

6.3 Following receipt and verification of the above details by the Promoter and the Winner has satisfied these terms and conditions, the Winners will be contacted so that arrangements of the prize delivery can be made.

7. COMPETITION PRIZES

7.1 Details of each Prize can be found on the Website. Utopia Wins take no responsibility for the Prize awarded after delivery has taken place. Once the Winner receives the Prize, Utopia Wins does not insure the Prize. For Avoidance of doubt No Insurance comes with the Prizes and Utopia Wins is not responsible for the Prize once it has been handed over to the Winner.

7.2 The Promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the prize.

7.3 Holiday Prizes/Experience Prizes:

a. Winners are solely responsible for all insurance, applicable taxes and for any expenses not specified in the description of the prize. Travel insurance remains the duty of the competition winner.

b. Utopia Wins is NOT liable for any additional costs which may occur at the accommodation due to personal use.

c. Utopia Wins will only be liable in booking the accommodation and/or the travel cost as stated in the competition. Any upgrades to flights, other travel or accommodation will NOT be covered by Utopia Wins.

d. Any changes to the travel bookings i.e. Date or Name Change after the prize has been claimed may be subject to an additional premium. Additional premiums are NOT covered by Utopia Wins.

e. Any damage incurred to the accommodation property will be the liability of the competition winner and is NOT covered by Utopia Wins.

f. Any additional charges to the accommodation room is the liability of the competition winner.

g. Utopia Wins will not be responsible for any further action taken against the Winner if all additional premiums or charges to the accommodation are not paid.

h. ANY damage of any kind must be reported to the accommodation management and is the liability of the competition winner. Utopia Wins will not be held liable for any damage or additional fees/fines.

8. free entry

To enter any Competition for free, you must first create an account and then send your name, address, date of birth, e-mail address and contact telephone number on a postcard to the Promoter. Free entries must be posted to - Utopia Wins Ltd, 41 Worsley Road, Bolton, BL4 9LR, UK and must arrive before the Competition closing date. First or second-class postage must be paid. Only one postal Entry per person for each Competition will be allocated a random ticket number by the promoter, each entry is to be submitted individually by postcard. The Entrant must specify which Competition they wish to enter and clearly state the answer to the skill based question for that Competition. All free Entries will be treated the same as a paid Entries. Where applicable, these Competition terms and conditions also apply to free Entries.

9. LIMITATIONS OF LIABILITY

In so far as is permitted by law, the Promoter will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter. Your statutory rights are not affected.

10. USE OF THE WEBSITE

If you notify your bank (or building society) that your debit card has been used without your permission in relation to a Competition and your nominated bank (or building society) asks the Promoter to return the relevant amount to your account, the Promoter may suspend your account and ask you to contact the Promoter. The Promoter accepts no responsibility and will have no liability to any chargebacks.

11. DATA PROTECTION NOTICE

Any personal data that you supply to Utopia Wins or authorise Utopia Wins to obtain from a third party, i.e. a credit card company, will be used by Utopia Wins to administer the Competition and fulfil prizes where applicable. In order to process, record and use your personal data Utopia Wins may disclose it to; any credit card company whose name you give and/or any person to whom Utopia Wins proposes to transfer any of Utopia Wins rights and/or responsibilities under any agreement Utopia Wins may have with you, any person to whom the promoter proposes to transfer its business or any part of it, comply with any legal or regulatory requirement of the Promoter in any country, and prevent, detect, or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
